Information Clause

In accordance with the art. 13 section 1 and 2 of the European Parliament and Council Regulation 2016/679 of the 27th April, 2016 on the protection of natural persons, with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereafter RODO, I hereby inform that:

1. EVERMOTION S.C., 8 Przędzalniana Str., 15-688 Białystok, Poland is the Administrator of your Personal Data (APD)

2. Data Protection Inspector can be reached through e-mail: iod@evermotion.org

3. Your personal data are to be processed on the basis of art. 6 section 1 letter a, b and f of RODO in order to:
a) prepare, conclude and execute the agreement and for other purposes approved by you,
b) to execute the legitimate interest like marketing of products and the agreement, claim assertion or defence against claims resulting from the law regulations.

4. Entities entitled to the reception of your personal data may be the authorised public bodies; mail providers; providers of the services covered by the agreement; responsible for debt recovery, keeping the archives, document utilization, legal consulting, technical services, IT services and accountancy.

5. Your personal data shall not be transferred to the third country, nor to the international bodies.

6. Your personal data shall be processed within the period of the agreement and upon your additional consent until you withdraw it. APD shall keep the data for the period of any civil law claim execution connected with the agreement.

7. You have the right to demand an access to your personal data, to correct or to delete the data if there is no other basis for the processing or any other purpose of such processing or to limit the processing of the data, to transfer the data to another administrator and to raise objections to the further data processing if there is no legal basis for further processing and to withdraw any previous consent.

8. You provide the personal data voluntarily, however they are necessary to conclude the agreement. The refusal of providing such data may result in the refusal of the agreement conclusion.

9. You have the right to lodge a complaint to the Personal Data Protection Office when in your opinion the data processing violates the regulations of General Data Protection Regulation of the 27 April, 2016 (RODO).

10. Your data will be automatically processed, including the form of profiling.
11. You are obligated to forward above mentioned information to your representative, especially if you appointed this person in the agreement as the contact person or as the representative for the agreement execution.

ORDER INFORMATION CARD

1. The main characteristics of rendered services is to conclude the agrement on sale of the licence for Evermotion Products between Evermotion and a User.

2. The main means of comunication with a User is via Internet (e-mail: info@evermotion.org) or phone number +48 85 674 50 05, there is also the possibility of written correspondence directed to the registered office of Evermotion.

3. The seller is Evermotion with its registered office in Białystok Przędzalniana St. 8, 15-688 Białystok (Poland) NIP 542-29-10-299.

4. The complaints may be submitted to the address of registered office of Evermotion.

5. Total price for rendered service, together with taxes and additional fees is given at checkout.

6. There are 2 methods of payment available in Evermotion Store: via PayPal and by transfer made directly to Evermotion. The fastest form of payment is the option of making payments via PayPal. The files are made available within maximum 3 days after making payment by the Licensee. The data for making the payment are sent by e-mail automatically after the placing of the order with the indication of the chosen form of payment. The Evermotion Products are made available only after crediting the transferred amount to the Evermotion account but not later than after maximum 3 days after the day of recording the payment of defined remuneration for the purchase of the Licence.

7. Evermotion Products are available as downloads. You can download them after purchases via Customer Zone. The Unregistered User receives the link with the password to download. Registered Users use their own password and login. Each Evermotion Product made available on Customer Zone portal may be downloaded 10 times. In case if you cannot download purchased products using this limit, contact Evermotion Support via contact form on www.evermotion.org page.

8. Evermotion Products are non-refundable. Evermotion grants one-year guarantee for Evermotion Products which are subject of the Agreement.

9. Evermtion would consider the complaint within 14 days (according to Polish law) from the date of receipt of the complaint. Immediately after considering the complaint Evermotion will provide the User with the answers on the complaint. The answer will be sent in the same form in which it was received by Evermotion.

10. Both User being entrepreneur as well as being consumer does not have a right of withdraw or abandon the transaction after the order on the website of Evermotion. The Consumer is not entitled to withdraw under Art. 27 of the Act of 30 May 2014. About consumer rights in accordance with the fact that the Transaction relates to the digital content that is not stored on the carrier material and the performance has begun with the express consent of the Consumer before the deadline to withdraw from the contract which the consumer was informed and agreed to by accepting the Regulations.

11. License Agreement is concluded for an indefinite period, the Licensee has the right to terminate it at any time without notice, but the Licensor has the right to terminate the Agreement only in the event of breach of contract.

12. Subject of the agreement are digital files in download version subject to download on User’s equipment.
